Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Billings Pioneer ("we", "us", "our"), operator of billingspioneer.com (the "Site"). By accessing or using the Site or submitting a loan request, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, a legal U.S. resident, and have the authority to enter into these Terms. You represent that all information you provide is truthful, accurate, and belongs to you.

2. Nature of our service

Billings Pioneer is a free consumer referral and comparison service. We are not a lender, we do not make credit decisions, and we do not guarantee that any lender will approve you or extend credit on any particular terms. We forward the information you submit to third-party lenders and lending partners that we believe may be able to help you. All loan offers, rates, fees, and terms come directly from the lender, not from us.

3. No offer of credit

Nothing on the Site is an offer or commitment to lend. Approval, loan amount, APR, fees, and repayment terms are determined by the lender based on your creditworthiness, state of residence, applicable law, and ability to repay. Not all consumers will qualify, and not all lenders in our network offer every loan amount advertised.

4. Your submissions

When you submit the loan request form, you authorize us to share your information (including your name, contact details, requested amount, purpose, employment, income, credit range, ZIP, and bank name) with our lending and marketing partners. You also grant us the consent described in our Privacy Policy and the disclosure shown at submission, including for calls, SMS, and email — see Section 5.

5. Communications and TCPA consent

By submitting the form, you provide express written consent to receive telephone calls, SMS/text messages, artificial or prerecorded voice messages, and emails from Billings Pioneer and its lending, servicing, and marketing partners at the number and email you provided, including via automatic telephone dialing systems, for marketing and servicing purposes, even if your number is on a Do Not Call registry. Consent is not a condition of any loan or service. Message and data rates may apply. Reply STOP to any text to opt out of SMS from that sender, or ask a caller to place you on their internal Do Not Call list.

6. Acceptable use

• Do not submit false, misleading, or third-party information without authorization.
• Do not attempt to disrupt, reverse engineer, scrape, or overload the Site.
• Do not use the Site for any unlawful purpose or in violation of any applicable law.

7. Third-party sites and lenders

The Site may link to, or you may be transferred to, third-party lender websites. We do not control those sites, are not responsible for their content, privacy practices, or loan products, and their inclusion is not an endorsement.

8. Intellectual property

The Site, including text, graphics, logos, and code, is owned by Billings Pioneer or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LENDER WILL APPROVE YOU.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BILLINGS PIONEER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold Billings Pioneer harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your submissions, or your misuse of the Site.

12. Arbitration and class-action waiver

Except where prohibited by law, any dispute arising out of or relating to the Site or these Terms shall be resolved by final, binding, individual arbitration under the rules of the American Arbitration Association, in the state of Montana. You and Billings Pioneer waive the right to a jury trial and to participate in a class action. You may opt out of arbitration by sending written notice through our Contact page within 30 days of first using the Site, including your full name and a clear statement that you wish to opt out of arbitration.

13. Governing law

These Terms are governed by the laws of the State of Montana, USA, without regard to conflict-of-laws principles. Exclusive venue for any non-arbitrable matter is in the state or federal courts located in Yellowstone County, Montana.

14. Changes

We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
